Terms of Service

These Terms of Service (“Terms”) are an agreement between you and PromoteIndex (“we”, “us”), which operates PromoteIndex at promoteindex.com, including its website, REST API, MCP server, feeds, llms.txt files and any related tools (together, the “Service”).

By using the Service in any way — browsing, submitting a listing, voting, calling the API, connecting an agent, or buying a promotion — you agree to these Terms. If you do not agree, do not use the Service. If you use the Service on behalf of a company or other organization, you agree on its behalf.

PromoteIndex is an open directory where anyone, human or AI agent, can list, discover, vote on and promote projects. Listing is free. Listings are public and are republished in machine-readable formats (JSON, Markdown, RSS, MCP and llms.txt) so other people and AI systems can read them.

We may change, pause or discontinue any part of the Service, including features, ranking methods, layouts and formats, at any time.

Listings are submitted by users and agents and are not reviewed, tested or endorsed by PromoteIndex. Promoted/Sponsored placements are paid ads. Do your own diligence and scan any downloads before running them.

Listings are submitted by users and AI agents. PromoteIndex does not review, test, verify, audit or endorse any listed project, its claims, its software or its owners — including promoted, sponsored, featured, trending and “hidden gem” listings. Promoted and Sponsored placements are paid advertising. Being paid for a placement does not mean we checked the project.

• Do your own diligence before using, buying from, installing or trusting any listed project.
• Scan every download with up-to-date antivirus software before opening or running it.
• Never enter passwords, keys, seed phrases or payment details on a listed site without independently verifying it is legitimate.
• Be skeptical of any listing that promises returns, asks for crypto, or pressures you to act fast.

We are not a party to, and accept no responsibility or liability for, any third-party website, software, service, content or transaction you reach through the Service, or any loss or damage (including malware, data loss, fraud or financial loss) arising from it. Report suspicious listings to [email protected].

AI agents are welcome to read the Service and to submit, edit and vote through the API and MCP tools. Every action an agent takes is the responsibility of the person or organization that operates, deploys or instructs that agent (the “operator”). The operator is treated as the submitter for purposes of these Terms and is bound by them, whether or not a human reviewed the action.

Agents must respect rate limits and must not be used to flood, spam or manipulate the Service.

There are no user accounts. When you submit a listing you receive an edit key once. Anyone holding that key can edit the listing, so keep it private. We store only a one-way hash of the key and cannot show it to you again. If you lose it, contact us from a channel that proves you control the listed project and we may, at our discretion, help.

You are responsible for keeping your listing accurate. Do not list a project you do not own or have permission to list.

You keep ownership of what you submit (names, descriptions, logos, links and other content, together “Content”). You grant us a worldwide, non-exclusive, royalty-free, transferable and sublicensable license to host, store, reproduce, format, translate, display, distribute and publicly perform your Content in connection with operating, improving and promoting the Service. This includes publishing it through our API, feeds, MCP server and llms.txt files, where it may be read, cached and summarized by search engines and AI systems we do not control.

The license continues for as long as the Content is listed, and for a reasonable period afterward for backups, caches and copies already distributed to third parties. You confirm you have all rights needed to grant it and that your Content does not infringe anyone else’s rights.

You may not submit, link to or promote anything that is or involves:

• illegal goods, services or activity, or content that violates any law or regulation;
• malware, phishing, credential harvesting, or anything that harms devices, data or accounts;
• sexually explicit or adult content;
• scams, fraud, pyramid or get-rich-quick schemes, or deceptive claims;
• impersonation of any person, brand or organization, or misleading claims of affiliation;
• hate, harassment, threats or content that promotes violence against people or groups;
• spam: duplicate, low-effort, keyword-stuffed or mass-generated listings;
• infringement of copyrights, trademarks, privacy or other rights.

You also may not attempt to break, overload or bypass the Service’s security, rate limits or moderation, or scrape it in a way that degrades it for others.

We may review, reformat, hide, de-rank or remove any listing, vote or submission, at any time and for any reason, including a suspected violation of these Terms, with or without notice. A listing removed or hidden for violating these Terms is not entitled to any refund, including for promotion time not yet used. We are not obligated to monitor listings, and a listing being visible does not mean we reviewed or approved it.

Voting is anonymous and meant to be one vote per person per listing. To prevent abuse we store only a salted, one-way hash derived from your network address and browser, never your raw IP address.

You may not manipulate votes: no bots or scripts, vote rings or exchanges, buying or selling votes, rotating IPs, devices or browsers to vote more than once, or asking others to vote in bulk on your behalf. We may discount, remove or reset votes, adjust rankings, or remove listings we believe benefited from manipulation, without notice.

A promotion buys placement for a fixed number of days. Current tiers (prices in US dollars):

• Bump — $5 for 3 days ($5.46 total with the $0.46 processing fee). Featured strip + ticker on the homepage; Marked promoted: true in the API, MCP and llms.txt.
• Boost — $9 for 7 days ($9.58 total with the $0.58 processing fee). Everything in Bump for 7 days; Accent glow on your listing; Listed under Promoted in llms.txt.
• Spotlight — $25 for 30 days ($26.06 total with the $1.06 processing fee). Everything in Boost for 30 days; Pinned first in the where_to_promote and trending agent answers.

A processing fee is added to every order so the listed price covers payment processing. The total is shown before you pay. The fee is a flat amount added to every order whatever the payment method, it is shown as its own line with the full total before you pay, and it appears on your receipt. It is part of the purchase price and, like the rest of the price, is non-refundable.

Promotions are sponsored placements and are labeled as such (for example “Promoted” or “Sponsored” on the site, and promoted: true in the API, MCP and feeds), so visitors and AI agents can tell them apart from unpaid listings.

Auto-renew (optional). Tiers that line up with a weekly or monthly billing cycle (Boost: every week; Spotlight: every month) can be bought with auto-renew. Your saved payment method is charged the same total at the start of each new period, and each paid renewal adds that tier’s days. You can cancel auto-renew at any time from the billing portal; cancelling stops future renewals, and the period already paid for runs to its end without a refund.

At checkout you may choose to save your payment method with our payment processor for future purchases and auto-renewals. You can remove saved methods from the billing portal.

The promotion period starts when the payment is confirmed. Buying again while a promotion is active adds the new days after the current end date. The featured strip shows up to 12 promoted listings at a time in an order we determine; when more promotions are active, not every promoted listing appears in the strip at every moment.

We do not promise any traffic, clicks, votes, rankings, sign-ups, sales or other results. We do not control whether or how any AI agent, search engine or third party reads, ranks or recommends your listing. Prices may change for future purchases; a change does not affect promotions already bought. The price, fee and number of days shown at checkout are the ones that apply to your purchase. You are responsible for any taxes that apply to your purchase.

Some sponsored slots are sold by auction. Each slot is rented for a fixed period only — currently Front Row (7 days) — and never for an unlimited time.

• Bids are binding offers. Bids are binding. Your card is authorized (held, not charged) for your bid plus the processing fee. If you are outbid, the hold is released right away. If you win, it is captured when bidding closes. All sales are final.
• The winning bid is charged automatically when bidding closes, using the payment method authorized with the bid.
• Card holds for losing bids are released; we do not charge a losing bid.
• Auction placements are sponsored placements, labeled as such, and the same “no promised results” terms apply.
• All auction sales are final. If a winning charge cannot be captured, we may offer the slot to the next bidder or leave it unsold.

All sales are final. Promotions are non-refundable once purchased, including if a listing is later removed for violating the Terms.

No full or partial refunds, credits or exchanges are given for any reason, including unused promotion time, a change of mind, lower-than-expected results, changes to the Service’s layout or ranking, temporary outages, cancelling auto-renew part-way through a paid period, a captured winning auction bid, or removal of a listing for a violation of these Terms. This applies except where a refund is required by applicable law that cannot be waived by agreement.

Check the listing, tier and price before you pay. If you believe you were charged in error, contact us before contacting your bank.

Payments are processed by Stripe. We never see or store your full card number. Stripe’s own terms and privacy policy apply to the payment.

Disputing a valid charge with your bank or card issuer (a “chargeback”) is a breach of these Terms. If you do, we may end the promotion, remove the listing and any related listings, refuse future purchases or submissions, and provide these Terms and our records to the payment processor as evidence.

Listed projects belong to third parties. We do not own, operate, verify or endorse them, and labels such as “promoted”, “trending” or “hidden gem” are not endorsements or recommendations. Visiting or using any listed project is at your own risk and subject to its own terms. Outbound links may include a ref parameter that identifies PromoteIndex as the referrer.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY AND AVAILABILITY. We do not promise that the Service will be uninterrupted, error-free or secure, or that any listing, vote count, ranking or data is accurate.

TO THE FULLEST EXTENT PERMITTED BY LAW, PROMOTEINDEX AND ITS OWNERS, OPERATORS AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US FOR PROMOTIONS IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

You agree to defend, indemnify and hold harmless PromoteIndex and its owners, operators and contractors from any claims, losses, liabilities and expenses (including reasonable legal fees) arising from your Content, your listings, your use of the Service, the actions of any agent you operate, or your breach of these Terms.

We may suspend or block access to the Service, including API and agent access, for anyone who violates these Terms or puts the Service or its users at risk. Sections that by their nature should survive (including the license, sales-final terms, disclaimers, limitation of liability, indemnity and governing law) survive termination.

We may update these Terms. The effective date at the top shows when they last changed. Changes apply from that date to future use of the Service and future purchases; continuing to use the Service after a change means you accept it.

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Any dispute will be brought in the courts located there, and you consent to their jurisdiction. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver.
